1. Acceptance of these Terms

By accessing or using vivenciaedu.com ("the Site") — including browsing programme pages, submitting a consultation enquiry, buying a book at /shop, or taking an assessment — you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you do not agree, please do not use the Site.

These Terms form a legally binding agreement between you and Vivencia Educational Services, Plot No. 288, Road No. 78, Jubilee Hills, Hyderabad 500033, Telangana, India ("Vivencia", "we", "us").

2. What we offer through this Site

• Institutional consultations — you can request a free consultation about Vivencia programmes for schools.
• Books shop — you can buy printed books, workbooks, and journals for students and parents.
• Programme information — descriptions of our Entrepreneurship, Financial Literacy, and AI/Robotics programmes.
• Assessment tools — quizzes and (when made available) proctored tests.

Submitting a consultation enquiry, signing up as a customer, or completing an assessment does not automatically create a paid service engagement. Any institutional engagement is formalised through a separate written agreement signed by both parties.

3. Customer accounts (books shop)

To place an order at /shop you may create a customer account. By creating an account you confirm that:

• You are at least 18 years old, or are the parent or legal guardian of a minor on whose behalf you are placing the order.
• The information you provide is accurate and current. You will keep it updated.
• You will not share your account credentials with anyone else, and you accept responsibility for all activity on your account.
• You will notify us immediately if you suspect any unauthorised use of your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraud, abuse, or unlawful activity.

4. Orders, prices, and payment

• Currency — all prices are listed in Indian Rupees (INR) and include GST unless stated otherwise.
• Price changes — we may revise prices at any time. The price applicable to your order is the price displayed at the moment you place it.
• Order acceptance — your order is an offer to buy. We accept the order when we send a confirmation email or when payment clears.
• Stock — if an item is out of stock after your order is placed, we will offer a full refund or a delayed-dispatch option.
• Payment — online payments are processed by a PCI-DSS-compliant payment gateway. Cash on Delivery is available where shown at checkout. Vivencia never sees or stores your card details.
• Tax invoices — an invoice is emailed once payment is confirmed. GST invoices can be requested by writing to info@vivenciaedu.com.

5. Shipping

Books are dispatched from Hyderabad within 1 to 2 working days of order confirmation. Delivery typically takes 3 to 6 working days across India, subject to courier availability and pincode serviceability.

Shipping is free above the order-value threshold shown at checkout (currently ₹ 999). Below that threshold a flat shipping fee applies. We use third-party courier aggregators; once shipped, you will receive an AWB tracking number you can use on the courier's tracking page.

Risk of loss or damage passes to you when the parcel is delivered to the address you provided. If a parcel is reported lost or damaged in transit, contact us within 7 days of the recorded delivery date so we can raise a claim with the courier.

6. Returns and refunds

• Eligibility — unused books in original packaging can be returned within 7 days of delivery.
• Initiation — email info@vivenciaedu.com with your order number and the reason for return. We will share the return courier details.
• Damaged or wrong items — share photos of the parcel and the item within 48 hours of delivery; we will replace or refund without return shipping cost to you.
• Refund timeline — once we receive and inspect the returned book, the refund is issued within 5 working days to the original payment method.
• Non-returnable items — opened workbooks with student writing, journals with personal entries, and any download or digital content cannot be returned.

7. Acceptable use

You agree not to:

• Attempt to access admin areas, other users' accounts, or non-public APIs without authorisation.
• Probe, scan, or test the security of the Site, run automated scrapers, or submit fake form data.
• Upload anything that contains malicious code, infringes intellectual property, or violates Indian law.
• Use any assessment tools to cheat or impersonate another candidate.
• Use information obtained through the Site to send spam or harassing communication to school staff.

We may suspend access without notice if we observe activity that endangers other users or the Site itself.

8. Intellectual property

The Site, the Vivencia name and logo, programme designs, curriculum frameworks, course outlines, workbooks, assessment items, and all written, visual, and code content are the property of Vivencia or its licensors and are protected by Indian and international copyright and trademark laws.

You may view and download personal copies for non-commercial purposes. You may not republish, sell, copy into your own materials, train AI models on, or commercially exploit any content without written permission from Vivencia.

Books sold through the shop are licensed for personal use by the buyer's household or by the school that purchased them. Bulk reproduction, photocopying, or redistribution of a purchased book requires a separate licensing agreement.

9. User-submitted content

When you submit text, files, or images through the Site (consultation form, account profile, assessment answers, support emails), you confirm that you have the right to share that content and you grant Vivencia a non-exclusive, royalty-free, India-wide licence to use it strictly for the purpose for which it was submitted.

10. Third-party links and embeds

The Site links to third-party services (social media, courier tracking, payment gateways, embedded Google Maps). These are operated by other companies under their own terms and privacy policies. Vivencia is not responsible for the content, availability, or practices of third-party services.

11. Warranties and disclaimers

The Site and the information on it are provided on an "as is" and "as available" basis. To the maximum extent allowed by Indian law, Vivencia disclaims:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any guarantee that the Site will be uninterrupted, error-free, or fully secure.
• Any guarantee that the educational content will produce specific learning outcomes for every student.

12. Limitation of liability

To the maximum extent allowed by Indian law, Vivencia's total liability arising out of or in connection with your use of the Site, in any 12-month period, shall not exceed the amount you actually paid to Vivencia for goods or services in that period (or ₹ 5,000 if you did not make any payment).

Vivencia is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profit, data, goodwill, or business opportunity, even if advised of the possibility of such damages.

13. Indemnity

You agree to indemnify and hold harmless Vivencia, its directors, employees, and contractors against any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party right.

14. Modifications to these Terms

We may revise these Terms as our services evolve or as the law changes. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after a change means you accept the revised Terms.

15. Termination

You may stop using the Site at any time. We may suspend or terminate access for users who breach these Terms, attempt to harm the Site, or whose continued access would expose us to legal risk.

16. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Hyderabad, Telangana, India.

Where Indian law permits, the parties may also attempt to resolve disputes through good-faith negotiation or mediation before approaching the courts.
